Pacific Medical Centers MyChart

Terms and Conditions of Use

Pacific Medical Centers “MyChart”1 is a secure online healthcare connection available via a link on the Pacific Medical Centers Website (the “Website”) or through a mobile software application (the “App”) that allows Pacific Medical Centers personnel to communicate with a patient or proxy, and allows authorized individuals instant access to certain electronic records containing patient confidential medical information. As used in these Terms and Conditions, the term “MyChart” refer to both the Website and the App unless only one product is specified. To qualify as an authorized user (“User”) of MyChart you must be a Pacific Medical Centers patient 18 years of age or older or a person legally authorized to act as a proxy for a patient under 13 years of age. If you are under 13 years of age, you may use MyChart only with the involvement and permission of a parent or guardian.

NOTE: MyChart is not an emergency response system and is not to be used as a substitute for calling 911 or for seeking immediate medical attention.

By downloading, installing, accessing or using MyChart, you agree that your use of MyChart is subject to compliance with the terms and conditions set forth below (the “Terms”), please read them carefully.

1. Use of MyChart Through MyChart, Users can efficiently and confidentially communicate various types of important information. Through the MyChart system Users may:

Your user ID and password must not be shared with any third party. By sharing a MyChart user ID and password with another person, the User bears the risk that the person may share or disclose confidential medical information to third parties without authorization. By agreeing to these terms and conditions, you agree to bear all liability for any damages or harm that may arise from disclosing your ID and password to a third party.

It is your responsibility to keep your ID and password safe and secure, and to immediately change your password anytime you believe that its security may have been compromised. MyChart will automatically close a session after 15 minutes of inactivity. However, you should immediately log out of any active sessions of MyChart before stepping away from a computer that is in a public location, or any other location where unauthorized persons might access the computer, using another application on your mobile device or allowing another individual to use your mobile device. If you chose to save or print copies of any record or information from MyChart, it is your responsibility to make sure that you do so in a reasonably secure place and manner.

NEVER send messages seeking urgent or emergency medical attention using MyChart. Pacific Medical Centers providers and staff do their best to read and respond to requests within three business days. However, delays may occur and messages may be lost as a result of technical or human errors. For all urgent medical matters, contact your health care provider's office immediately, go to an emergency room, or call 911.

2. Account Activation Once you sign up for MyChart, you will be given a temporary access code that you will use to activate your account via the Website. When you activate your account, you will create your own MyChart ID, password and password hint. Save your password in a secure location and DO NOT SHARE your password with anyone.

A. From the time you receive your temporary access code, you will have 30 days to log-on and activate your MyChart account; after 30 days the access code will expire.

B. After you have activated your MyChart account, you will receive important messages from your medical care team and test results and other personal medical information through MyChart. You will continue to receive communications from Pacific Medical Centers via mail and telephone as well.

C. You must provide a valid, secure email address when activating your MyChart account and keep your email address current via the "Personal Preferences" link in MyChart. Confidential information will not be sent to your email, but MyChart will provide email notifications when events or information are posted to your MyChart account.

D. Pacific Medical Centers currently offers MyChart as a free service and a convenience to our patients. Pacific Medical Centers reserves the right in the future to charge fees for the use of MyChart. You will be notified of this change and asked to re-active your account if you agree to the fee and wish to continue with this service.

E. Once you have registered on the Website, you will be able to download the App. Please note that while the Website and the App are different software programs, your use of each is governed by these Terms.

3. Electronic Messages

A. Messages sent through MyChart may not be limited to your provider. Your physician or other professional health care provider may designate other Pacific Medical Centers personnel to manage and respond to your messages. These may include nursing or other administrative staff who review messages and either respond or route the message to a provider for response. Accordingly, you may not wish to use MyChart messaging to communicate sensitive matters that you may wish to discuss directly with a specific health care provider.

B. All communications between you and your Pacific Medical Centers personnel using MyChart are carried over a secure, encrypted connection. While you may receive e-mail messages notifying you of new messages or information in your MyChart Inbox, these e-mails will not contain any confidential medical information. By using MyChart you acknowledge and agree that such messages may identify you as a patient of Pacific Medical Centers.

C. Any information you transmit via MyChart may become part of the corresponding permanent patient medical record. You should be aware that once information is transmitted via the MyChart system, it will be accessible to current and future Pacific Medical Centers health care provider(s) and staff members who are appropriately involved with providing care, and may be made available to authorized third parties consistent with the MyChart Privacy Policy.

D. In using the MyChart system for communications you agree that you will not upload or transmit any communications or content of any type (including secure messaging) that may infringe upon, misappropriate or violate any rights of any party. Accordingly, the following actions shall constitute a material breach of these Terms and Conditions:

4. Medical Record Data

A. As an employer of licensed health care providers in the State of Washington, Pacific Medical Centers is required to maintain documentation of patient medical history, current conditions, treatment plans and all treatments given, including results of all tests, procedures and therapies. Pacific Medical Centers will make much of that information available through MyChart.

B. However, the MyChart online service is not designed to provide online access to all medical records and does not necessarily reflect the complete contents of any given patient’s medical records. In addition, Pacific Medical Centers providers and staff may chose to not use MyChart communication tools, or not release reports, data, or information into MyChart at any time, in their discretion. Pacific Medical Centers will provide complete physical copies of medical records upon request; in certain cases, Pacific Medical Centers may charge fees for such records to offset the costs associated with providing records. Any charges will be in compliance with the Washington Administrative Code (WAC 246-08-400) or other applicable law.

C. Your health care providers will maintain and update your MyChart record at each office visit. However, if you believe any information displayed in MyChart is not accurate, you are encouraged to notify your health care provider at your next office visit or submit a message to your provider via MyChart.

5. Information Does Not Constitute Medical Advice Pacific Medical Centers assumes no responsibility for how patients use the information obtained from MyChart. Patients should consult with a physician or other health care provider regarding their personal health condition and any information obtained or accessed from the MyChart system. Information obtained from the MyChart system is not an appropriate substitute for direct consultation with your health care provider.

6. Termination and Suspension of Access Pacific Medical Centers expressly reserves the right, in its sole discretion, to terminate, restrict, or suspend a User's access to any MyChart interactive services and/or to any or all other areas of the MyChart system due to any act that would constitute a violation of these Terms . Furthermore, Pacific Medical Centers reserves the right to restrict or suspend User access to MyChart for any technical or commercial reason. If access is suspended for planned maintenance of the MyChart system, every effort will be made to communicate downtime to all users in advance. However, there may be incidents where Pacific Medical Centers must suspend access to MyChart without advance notice. If your use of MyChart violates these Terms, Pacific Medical Centers reserves the right to permanently terminate your access to MyChart.

7. Restrictions on Use and Ownership The contents and information provided through the MyChart system are provided for Pacific Medical Centers and its patients only. The words “Pacific Medical Centers” and its associated logo are the trademarks and service marks of Pacific Medical Centers. All other trademarks, service marks, and logos used with the MyChart system, including but not limited to “MyChart,” are the trademarks, service marks, or logos of Pacific Medical Centers’ licensor, Epic Systems Corporation. Nothing in these terms and conditions and nothing on the MyChart system should be construed as granting any license or right to use any trademark, service mark, or logo displayed by the MyChart system.

Pacific Medical Centers grants a limited license to each authorized User to make personal use only of the MyChart system and the associated services in accordance with these terms and conditions of use. This license expressly prohibits, without limitation, any reproduction, duplication, sale, resale or other commercial use of the MyChart system, source code, or associated services; furthermore, this license prohibits the production of any derivative of the MyChart system or the associated services, the collection and use of user email addresses or other users information, including, without limitation, health information or any data extraction or data mining whatsoever.

8. Accuracy and Integrity of Information Although Pacific Medical Centers attempts to ensure the integrity of the MyChart system, it makes no guarantees whatsoever as to the correctness or accuracy of information provided through the MyChart system. It is possible that the MyChart system could reflect or transmit typographical errors, inaccurate reports or data, or other errors. In the event that you discover any inaccuracy arises, please inform Pacific Medical Centers so that it can be corrected.

9. Security The MyChart system uses encryption software and other security measures to provide for the secure management and transmission of information. While we use state-of-the-art security, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. Furthermore, when using the MyChart system, information may be transmitted over servers and networks beyond the control of Pacific Medical Centers and its contractors. YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USER OF THIS SERVICE. Once the information is received by Pacific Medical Centers, your information will be protected as described in our Privacy Policy.

10. Links to Other Sites Pacific Medical Centers makes no representations whatsoever about any other web site that you may access through your use of MyChart. When you access a non-Pacific Medical Centers site, please be advised that it is independent from Pacific Medical Centers, and that Pacific Medical Centers has no control over the content on that web site. Pacific Medical Centers does not approve, monitor, endorse or accept any responsibility for the content or use of any other linked site. If you decide to access any third party sites linked to the MyChart system, you do so entirely at your own risk.

11. Disclaimer of Warranties. PACIFIC MEDICAL CENTERS DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. PACIFIC MEDICAL CENTERS WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY ERROR, DELAY OR INTERRUPTION IN THE APPLICATIONS OR ANY HEALTH CARE OR HEALTH PLAN SERVICES. PACIFIC MEDICAL CENTERS MAKES NO GUARANTEE, REPRESENTATION OR WARRANTY REGARDING THE TIMELINESS, RELIABILITY, ACCURACY, COMPLETENESS OR USEFULNESS OF ANY PORTION OF THE WEBSITE, THE APP, OR ANY HEALTH CARE OR HEALTH PLAN SERVICES ACCESSED THROUGH MYCHART, INCLUDING THE CONTENT MADE AVAILABLE THROUGH MYCHART, OR ANY HEALTH CARE OR HEALTH PLAN SERVICES, OR REGARDING THE AVAILABILITY OR APPROPRIATENESS OF THIRD-PARTY PROVIDERS OR PAYORS. YOU AGREE THAT YOUR ACCESS TO AND USE OF MYCHART AND ANY HEALTH CARE OR HEALTH PLAN SERVICES IS AT YOUR OWN RISK, AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY LIABILITY OR DAMAGE THAT YOU MAY INCUR THROUGH USE OF MYCHART AND ANY HEALTH CARE OR HEALTH PLAN SERVICES, EXCEPT TO THE EXTENT THAT THE APPLICABLE LAWS OF A PARTICULAR JURISDICTION CANNOT BE WAIVED OR EXCLUDED BY AGREEMENT.

12. Limitation of Liability PACIFIC MEDICAL CENTERS AND ITS AFFILIATES, SUPPLIERS, AND OTHER THIRD PARTIES MENTIONED OR LINKED TO ON MYCHART ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES (INCLUDING WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO MYCHART, MYCHART-RELATED SERVICES AND PRODUCTS, CONTENT OR INFORMATION CONTAINED WITHIN MYCHART, AND/OR ANY THIRD PARTY WEB SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH MYCHART, MYCHART-RELATED SERVICES, AND/OR THIRD PARTY WEB SITES OR APPS IS TO STOP USING MYCHART.

13. General

A. By accessing or using MyChart, I agree that I am entitled to the rights, and agree that I am bound to honor the obligations set forth in these Terms and the Pacific Medical Centers Privacy Policy, either of which may be revised from time to time by Pacific Medical Centers at its sole discretion. I acknowledge that I have a duty to regularly review these Terms and Conditions and the Privacy Policy posted on the MyChart system and Pacific Medical Centers website. My continued use of the MyChart system will signify my continued agreement to these Terms and Conditions as they may be revised. Notwithstanding the foregoing, Pacific Medical Centers will provide notice of such revisions through MyChart.

B. I understand and agree that the Pacific Medical Centers may make MyChart available in the English language only.

C. If I am a User legally authorized to act as a proxy for a minor patient, I understand and agree that Pacific Medical Centers will terminate my access to that minor patient’s corresponding account on the MyChart system upon the minor patient’s 13th birthday.

D. By using the Pacific Medical Centers MyChart system, I agree that the laws of the state of Washington will govern these Terms and any dispute that might arise between myself and Pacific Medical Centers, its providers, nurses, staff or other affiliates.

By clicking ‘Accept’, I acknowledge that I have read, understand, and agree to the above Terms . I further acknowledge and agree that downloading or installing the App constitutes my agreement that these Terms govern my use of that software.
